At SweatWorking, Inc. (“SweatWorking” or “we”), we respect the privacy of our users and recognize the importance maintaining a trusted relationship with our athletes, coaches and other users. This Privacy Policy (“Policy”) helps you to understand the kinds of information we may collect from users of our websites (the “Sites”) and / or our mobile applications (the “Applications”) and how we use and share such information.

This Policy governs your use of the Sites and Applications created by SweatWorking that collect analytic data and by installing and using any of these Sites and Applications you agree to the terms herein. All Sites and Applications that make use of this Policy are properly marked as such and this information can be found inside each of these Sites and Applications. We may change, modify, add, or remove portions of this Policy from time to time and without prior notice, and changes are effective upon posting unless we advise you otherwise. Your continued use of our Sites and Applications after changes are posted constitutes your agreement to the changes. You are advised to consult this Policy regularly for any changes, as continued use is deemed approval of all changes. If you do not agree to the terms of this Policy, please discontinue your use of the Sites and / or Applications.


Automatically Collected Information

Each time you provide or transmit information to us via the Sites or Applications, SweatWorking may obtain and collect personally identifiable information about you, including, but not limited to, your name, email address, and any other information that may be used to identify you. We may also collect non-personally identifiable information from you, including but not limited to zip code, gender, age, weight, fitness profile, comments, photographs, IP address, browser type, cookie identifiers, Internet Service Provider, referring and exit page, operating system, timestamps, clickstream data, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Site or Application, including, but also not limited to, the amount of time spent within the scope of any of the Sites and Applications, the usage-count for all features provided by the Sites and Applications, navigation information within the structure of any of the Sites and Applications and error messages created by the Sites and Applications. Further, we may also collect information from our business partners and from other third parties as further described in this Policy. We may combine the personal information we receive from different sources. We also track and analyze non-identifying and aggregate usage and volume statistical information from our visitors and customers. We may log and use this information for purposes such as helping diagnose technical problems and to administer our Sites or Applications so that we can improve it.


Sites and Applications do not collect any Sensitive Data

As set forth by this Policy, the term “Sensitive Data” refers to Automatically Collected Information that can associate the usage of Sites and Applications to a specific person’s physical addresses, banking information and other sensitive data. All Sites and Applications governed by this Policy refrain from collecting any Sensitive Data from users.


Sites and Applications do not collect GPS information

Sites and Applications governed by this app may collect location information. However, this information is only inferred from the data traffic that flows through the app and not by any kind of GPS technology. Therefore, location information collected by Sites and Applications are more imprecise. Location data is only used to create segmentation from all the data collected.
As SweatWorking does not collect any Sensitive Data, this information will not be associated with you, even in cases where Sites and Applications may use GPS information to work as intended.


Use of information; Third parties access

We may use the information we collect from and about you for any of the following purposes: (1) to fulfill your requests for workouts, challenges, or other products or services; (2) to respond to your inquiries; (3) to review Sites or Application usage and operations; (4) to address problems with the Sites or Applications, our business, or our services; (5) to protect the security or integrity of the Sites or Applications and our business; (6) to monitor the Sites and Applications for compliance with our Terms of Use and the law; (7) to help improve and customize our Sites, Applications, or services; (8) to contact you with updates and other informational and promotional materials from us or third party marketing offers from our trusted partners, as well as from other companies, (9) to send newsletters to our users, (10) process payment for products or services you order via our Sites or Applications, (11) publicly display feedback and comments posted by you on our Sites and Applications, and (12) manage your account and your preferences. In addition, SweatWorking may partner with third party advertisers to help deliver advertisements through the Sites or Applications relevant to your interests.


SweatWorking may share your information with third parties only in the ways that are described in this Policy. We may disclose Automatically Collected Information:


• as required by law, such as to comply with a subpoena, or similar legal process;
• when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
• with related companies, subsidiaries and affiliates to perform business, professional or support functions for us;
• with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this Policy. We also inform that Sites and Applications governed by this Policy currently make use of an analytics platform (“Service Provider”) and are subject to Service Provider’s policies as well;
• to our marketing partners, advertisers or other third parties, who may contact you with their own offers; and
• if SweatWorking is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Site of any change in ownership or uses of this information, as well as any choices you may have regarding this information.


We may also allow third-party advertising companies and ad networks, including content recommendation engines, to display advertisements on our Sites and Applications, and to track user activity on our Sites and Applications for the purpose of determining what ads to display. These companies may also use information collected on our Sites and Applications in order to better serve ads (ad retargeting). We do not provide any personal information to these companies. These companies may use tracking tools, such as cookies, to collect information about computers and browsing activity to determine which advertisements to display to users. Some of these companies may be members of the Network Advertising Initiative, which offers consumers the ability to opt out of ad targeting by all member companies (

We may share aggregated, anonymous information in any of the above situations and with service providers, advertisers and others for our own marketing purposes and for purposes of improving the manner in which, and to whom, we offer our services.


Interest-based advertising

We may partner with ad networks and other ad serving providers (“Advertising Providers”) who serve ads on behalf of us and others on non-affiliated websites or mobile applications. Some of those ads may be personalized, meaning that they are intended to be relevant to you based on information Advertising Providers collect about your visits to SweatWorking Sites and Applications and elsewhere over time.

You may visit to learn more about this type of advertising and how to opt-out of this form of advertising by companies participating in the Digital Advertising Alliance (“DAA”) self-regulatory program. Note that electing to opt-out will not stop advertising from appearing in your browser or applications. It may make the ads you see less relevant to your interests. In addition, note that if you use a different browser or erase cookies from your browser, you may need to renew your opt-out choice.


Apple HealthKit information

To provide our services, such as recommending workouts and challenges you may enjoy, we may read and / or write data to the Apple HealthKit database on your Apple device with your consent. We will not use this information for marketing or advertising purposes or share it with third parties.


You have control over the collection of data

You can stop all collection of information from within each of the Sites and Applications and / or opt-out of having your information shared with third parties. You may request to opt-out of the data collection and / or share program at any time by sending an email to [email protected] You may also stop all data collection by uninstalling the Sites and Applications . You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.


Data retention policy

We will retain User Provided data for as long as you use the Site or Application and for a reasonable time thereafter. We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete any user provided data that you have provided via the Application, please contact us at [email protected] and we will respond in a reasonable time. Please note that some or all of the user provided data may be required in order for the Site or Application to function properly.



We do not use the Sites and / or Applications to knowingly solicit data from or market to children under the age of 13. We will never knowingly collect any personally identifiable information about children under the age of 13. If SweatWorking obtains actual knowledge that it has collected personal information about a child under the age of 13, that information will be immediately deleted and will not be shared or disclosed to third parties in compliance with the Children’s Online Privacy Protection Act.



We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Sites and Applications. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches. Additionally, security measures are subject to our Service Provider.


Your consent

By using the Sites and Applications, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. “Processing,” means using cookies on a computer / hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in our Service Provider’s country and in the United States of America. If you reside outside any of these countries, your information will be transferred, processed and stored there under Service Provider’s country and the United States of America privacy standards.

The Sites and Applications may link to websites operated by third parties that we do not control. We do not monitor, control, or endorse the information collection or privacy practices of any third parties. We strongly encourage you to become familiar with the privacy practices of every website you visit and to contact them if you have any questions about their respective privacy policies and practices. This Policy applies solely to information collected by us through the SweatWorking Sites, Applications or services and does not apply to these third-party websites. The ability to access information of third parties from the SweatWorking Sites, Applications or services, or links to other websites or locations, is for your convenience only and does not signify our endorsement of such third parties, their products, services, websites, locations, or their content.
